Terms of Service – All Paving Inc.

Effective in the State of Florida – All Paving Inc.

By accessing our website or hiring our services, you agree to be bound by the following terms and conditions. These terms govern the provision of services by All Paving Inc. and are applicable to all work performed, unless otherwise stated in a formal written agreement.

1. Work Warranty

All Paving Inc. provides a limited warranty of 2 years on completed work.
Sealcoating is warrantied for 1 year.
Warranty on asphalt overlays is subject to the condition of the existing base/foundation.
We do not guarantee 100% drainage in areas where the grade slope is less than 1%.
Any damage caused by unauthorized access to the work zone after barricades or signage are in place voids the warranty.

2. Work Conditions

All services are scheduled and executed weather permitting.
Standard work hours are 7:00 AM to 5:00 PM, Monday through Friday, excluding holidays and weekends.
Vehicles left in the work zone are the owner’s responsibility. Delays caused by obstructions will be billed at $250/hour.
If additional asphalt leveling is required for drainage correction, overages will be charged at $125 per ton.

3. Permitting & Compliance

Permit fees are not included in the proposal and are billed at actual cost.
Expediting fees apply, with a $250 minimum in Broward County, and $500 minimum in other counties.
The hiring party (owner or authorized agent) is responsible for:
- Engineering, blueprints, and layout
- Soil testing and as-built surveys
- Applicable bonds or third-party services
If work is directed to proceed without required permits, the Owner/Authorized Agent accepts full responsibility for any resulting fines, fees, or violations.

4. Payment Terms

A 50% deposit is required upon contract signing.
An additional 30% is due on the first day of work.
18% is due upon completion of the agreed scope.
2% may be withheld until permits are officially closed.
Change orders or additions will be invoiced separately and do not delay payment of the original contract.
All pricing is based on full acceptance of the quoted scope of work.
A Notice to Owner may be filed, per Florida law.
Unpaid balances over 30 days past due will accrue 10% monthly interest.
The Owner is responsible for all collection-related fees and legal costs.

5. Disclaimers & Limitations

Conflicts with irrigation, electrical systems, or underground utilities will be addressed at the Owner’s expense.
This document forms a binding part of the service agreement between All Paving Inc. and the hiring party.
These terms supersede any prior oral or written agreements unless explicitly amended in writing by both parties.

6. Governing Law & Jurisdiction

Any disputes arising from services rendered shall be governed by the laws of the State of Florida.
The exclusive venue for resolving legal matters shall be the Fifteenth Judicial Circuit Court of Florida, located in Palm Beach County.
